AI Safety and Security:

The Executive Order introduces new legal standards for AI safety and security. Specifically, it mandates that developers of powerful AI systems must share safety test results and crucial information with the U.S. government. These legally binding directives are aimed at ensuring the stringent safety and security of AI applications, particularly those employed in healthcare. For the healthcare sector, this implies a legal obligation to rigorously test and verify the safety of AI-driven diagnostics, treatment recommendations, and patient care systems.

AI in Healthcare and Pharmaceuticals:

The legal framework within the Executive Order underscores a commitment to responsible AI utilization in healthcare and pharmaceuticals. It outlines a proactive stance in supporting the development of affordable and life-saving drugs through AI. In healthcare, this means that pharmaceutical companies and healthcare institutions must adhere to these legal standards when incorporating AI into drug discovery, patient care, and medical research. The legal safety program, designed to address potential harms or unsafe practices involving AI in healthcare, introduces strict accountability measures for the sector.

Data Privacy and Legal Obligations:

Privacy, especially in healthcare, is a paramount concern, and the Executive Order underscores this by calling for bipartisan data privacy legislation. From a legal perspective, this carries implications for how healthcare organizations handle patient data. Complying with robust data protection measures will be a legal obligation, and healthcare providers and pharmaceutical companies will need to ensure their practices align with the evolving legal landscape.

Copyright and Trademark:

The Executive Order emphasizes the protection of data that fuels AI systems while addressing privacy concerns. It mandates the development of guidelines to mitigate privacy risks, especially regarding data used for AI training. This initiative safeguards individuals' privacy, particularly when dealing with AI-generated content.

AI in Clinical Trials:

In the announcement, there wasn't huge focus on the clinical trial sector. In trials, where AI can optimize patient recruitment, data analysis, and safety monitoring, adhering to the legal standards for AI safety and security is, has been and will continue to be paramount. Legal compliance with AI-driven innovations in clinical trials will be required to expedite the development of new therapies while ensuring patient safety and data integrity.

What does this actually mean?

The legal implications of President Biden's Executive Order on AI are quite profound. It necessitates a heightened commitment to safety, security, and data privacy, particularly in the healthcare, pharmaceutical, and clinical trial sectors. Organisations in these sectors must proactively monitor and adapt to the evolving legal landscape, ensuring full compliance with the AI safety and security standards and data privacy legislation.

That all being said, new AI organisations aren’t unwise to the legal and regulatory landscape of pharmaceuticals and clinical trials, and have adopted heightened safety & privacy long before this executive order was established.

The establishing of these guidelines and further recognition of the advancement of AI will ensure people are protected and a positive ecosystem for new life changing technology can evolve.
